§ 1 Scope
(1) The following General Terms and Conditions form part of every contract between Trailblazer Summits GmbH, Papenstraße 33e, 22089 Hamburg (hereinafter: Provider) and the visitor to the Procurement Summit (hereinafter: Visitor).
(2) The Provider renders its services exclusively on the basis of these General Terms and Conditions.
(3) The validity of these General Terms and Conditions extends to all services offered by the Provider on this website. By making use of the Provider’s services, the Visitor acknowledges these General Terms and Conditions as binding upon them.
§ 2 Subject of the Contract
(1) The subject of the contract is attendance at the Procurement Summit.
(2) Attendance is subject to a fee. Various ticket categories are offered.
(3) Tickets for attending the Procurement Summit are transferable. The organiser offers customer support at info@procurementsummit.de, which can process a one-time name change on a ticket up to a maximum of 4 weeks before the event.
(4) By participating in the event, the Visitor consents to the use of the company logo by the Provider.
(5) Tickets are non-cancellable but transferable. Up to 2 weeks before the event date, each ticket may be transferred to another person free of charge by emailing info@procurementsummit.de.
§ 3 Conclusion of Contract
(1) The presentation of the Provider’s services, particularly in brochures, advertisements, and on the internet, does not constitute a binding offer but merely an invitation to submit an offer.
(2) The contract between the Provider and the Visitor is concluded through the Visitor’s registration on this website and its confirmation by the Provider.
§ 4 Limitation of Liability / Indemnification
(1) For damages other than those resulting from injury to life, body, or health, the Provider shall only be liable insofar as such damages are based on intentional misconduct or gross negligence, or on culpable breach of a material contractual obligation by the Provider, its employees, or its agents. This also applies to damages arising from breaches of duties during contract negotiations and from tortious acts. Any further liability for damages is excluded.
(2) Except in cases of intentional misconduct or gross negligence, breach of a fundamental contractual obligation, or injury to life, body, or health caused by the Provider, its employees, or its agents, liability shall be limited to damages typically foreseeable at the time of conclusion of the contract and otherwise to the amount of average damages typical for this type of contract. This also applies to indirect damages, in particular loss of profit.
§ 5 Data Protection
(1) The Provider shall use the data communicated by the Visitor (e.g. title, name, email address) in accordance with the provisions of German data protection law.
(2) The Visitor’s personal data may be passed on to exhibitors. The Visitor agrees to be contacted by exhibitors. The Visitor has the right to withdraw this consent at any time by emailing info@procurementsummit.de.
(3) Upon full completion of the contract, the Visitor’s data which must be retained for legal reasons shall be blocked. Such data will no longer be available for further use. Otherwise, personal data shall be deleted unless the Visitor has expressly consented to further processing and use of their data.
(4) Should further information be required, or if the Visitor wishes their data to be deleted, support is available at info@procurementsummit.de.
(5) By attending the event, the participant consents to the organiser using images and videos of them, including for promotional purposes.
§ 6 Duration of the Contract
(1) The contract is concluded for the duration of the Procurement Summit.
(2) The authorisation to attend the Procurement Summit shall expire if the Visitor withdraws their declaration of consent to these terms and conditions.
§ 7 Amendments
(1) The Procurement Summit reserves the right to reschedule, modify, or cancel the entire event or individual parts thereof at short notice. If the event is cancelled for important reasons, the customer shall receive a full refund of the participation fee. Claims for damages shall not exist unless there is intent or gross negligence on the part of the Procurement Summit. A rescheduling of the event shall not entitle the customer to cancellation.
§ 8 Final Provisions
(1) German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. Mandatory provisions of the state in which the customer has their habitual residence remain unaffected.
(2) Should individual provisions of this contract be invalid or conflict with statutory regulations, the remainder of the contract shall remain unaffected. The invalid provision shall be replaced by a valid one that comes closest to the economic and legal purpose of the invalid provision. The same applies to the filling of contractual gaps.
§ 9 Delivery Conditions
Delivery and shipping costs: Delivery by email is free of charge. If the customer requests a printed invoice, a processing and postage fee of EUR 5 will be charged.
